The fate of asylum seeker children born in detention rests upon baby Ferouz, whose case is before the Federal Court today. Lawyers are fighting for the Rohingyan baby and others like him, to be granted permanent protection.
If the case fails, the babies will be left in limbo indefinitely. This includes children who are considered stateless, like Ferouz, because his parents are not recognised as citizens in the country they’ve fled. Experts say the law is unclear, because there is no policy that refers to babies born in detention.
